BENEFITS UPDATE - FEBRUARY 2010

FMLA - The President of the United Sates on December 21, 2009 signed the Flight Crew Technical Correction Act. This action amended the Family Medical Leave Act (FMLA) of 1993 with respect to the hours of service requirement flight crews must meet to be eligible for leave under such Act. This revision declares that a flight attendant or flight crew member will be considered to meet such requirement if he or she has worked or been paid for:

(1) at least 60% of the applicable monthly guarantee or the equivalent for the previous 12 month period for or by the employer with respect to whom such leave is requested; and

(2) a minimum of 504 hours (not counting personal commute time, vacation leave or medical or sick leaves) during such period.

This means if you have 504 worked hours in a year, you can have FMLA. This means you no longer have to take 5 days off in a row. You may take 1, 2 or 3 days for your condition or that of a family member.

If you currently have PCL it will remain in effect until you need to reapply. If you want to change your PCL to FMLA this month, have your physician complete a new FMLA (WH380) form.

The PCL program will remain in effect for those flight attendants who do not meet the 504 hour requirement.
